Who is responsible for collecting and processing data?

Fertagus SA, (Hereinafter referred to as Fertagus) is the entity responsible for the collection and processing of personal data, and may, within the scope of its activity, use other entities subcontracted by itself to pursue the purposes stated here.

What is personal data?

Personal data is any information of any nature and regardless of its support, including sound and image, relating to an identified or identifiable person. Any person who can be identified directly or indirectly, through an identification number or one or more specific elements of his / her physical, physiological, psychic, economic, cultural, or social identity, shall be considered identifiable.

What is personal data?

What personal data is collected and processed?

Fertagus collects and manages, among others, the following personal data: name, telephone number, Personal Tax Number (NIF), Identity Card (Citizen's Card or Passport) and e-mail address.

Fertagus assumes that such data has been provided by the owner or that the user has given authorization to do so and will presume that it is correct, true, and up to date.

How does Fertagus collect your data?

Personal data is collected when you subscribe one of our products or services, or when you make a reservation/booking, request or contact through our websites, applications or via our Contact Center.

Personal data may be collected by the following means:

a) e-Mail;

b) Website;

c) Contact Center;

d) In person;

e) Through apps installed on mobile devices.

The collected data is processed and stored in a computer database, respecting strict rules, in compliance with the legislation of protection of personal data; it is stored in a specific database, created for this purpose, by Fertagus or by the entities subcontracted by it.

Some of the personal data collected on the website is mandatory and, in case of lack or insufficiency of such data, Fertagus may not be able to provide you with the services or information requested. In each case, Fertagus will inform you of the mandatory nature of the provision of the personal data in question.

What are the purposes and legal basis for processing your data?

In accordance with the Data Protection Principles Fertagus may only process your personal data for specific purposes and if it has a legal basis to do so. Transol uses your data for the following purposes and on the basis of the following grounds:

I. Based on the contract for transport services you have entered with us, we process your data for the purposes of:

a) Management of contractual relationship of the services provided by Fertagus ;

b) Advertising on our media;

c) Customer support;

d) Profile Update; And

e) Lost and found.

II. Because we are in the context of pre-contractual measures, we process your data for the purposes of:

a) requests for budget and information; And

b) Recruitment.

III. To comply with legal obligations, we process your data for the purposes of:

a) Complaint management; And

b) Compliance with other legal or regulatory obligations.

IV. Because you are our customer and we have a legitimate interest in wanting to provide you with a better service, we process your data for the purposes of:

a) Contact calendar;

b) Social Listening;

c) sharing of testimonies; And

d) Marketing actions.

V. Based on your consent, we process your data for the purposes of:

a) sending information on training initiatives or traineeships; And

b) Sending marketing actions (if not our customer).

In order to carry out the purposes identified above, Fertagus l may interconnect the collected data for the purpose of updating and completing such data.

With whom is your data shared?

The data collected and held by the Company may be transmitted, with due respect for the duty of confidentiality and the principle of the purpose that led to its collection, to the following entities:

a) Other companies of the group Fertagus is part of;

(b) judicial or administrative authorities, where such a means of such a restraining order;

(c) recruitment and selection companies;

What are your rights?

Under the Data Protection legislation, we guarantee you the right of access, update, rectification, delete, portability, and erasure of your personal data. You can also file complaints with the National Data Protection Commission.

We also give you the right to withdraw consent (non-customers) or to object the use (customers) of the data provided for marketing purposes, for sending informative communications or inclusion in lists or information services. For how long is your data stored?

The period of time during which the data is retained and stored differ accordingly with the purpose for which the data is processed.

Where there is no specific legal requirement, the data shall be retained and stored only for the minimum period necessary for the purposes that motivated its collection or subsequent processing, after which they will be deleted.

Is your data safe?

Fertagus is committed to ensuring the protection and security of your data. To that end, the Company has adopted a series of technical and organizational security measures in order to protect the personal data you make available to us, against its unauthorized diffusion, loss, misuse, alteration, treatment or access, as well as against any other form of illicit treatment.

Fertagus requires its subcontractors and its partners to adopt safety measures equivalent to those it practices. Notwithstanding the security measures practiced by Fertagus , the end User must take additional security measures, such as: ensuring that you use properly configured security-enhanced equipment and a Browser with an active firewall, anti-virus and antispyware, you should be aware of the authenticity of other websites you visit on the internet, avoiding websites that you do not trust.

Communication

Fertagus acknowledges that it will might be necessary to communicate data of Users solely within the scope of mergers, acquisitions and / or incorporation processes of which it might take part of, not considering that communication as a transfer of data to third parties, nor if there is any subcontracted treatment.

Fertagus l may also transmit data to third parties in the context of investigations, inquiries and judicial, administrative and / or similar proceedings, if it is duly ordered by a court order accordingly.

Data Transfer

In case of data transfers to third countries that do not belong to the European Union or to the European Economic Area, Fertagus will comply with the law, particularly regarding the suitability of the country of destination for the protection of personal data and the requirements which are applicable to such transfers, and personal data are not transferred to jurisdictions that do not provide security and protection guarantees.
